1. Introduction and Acceptance of Terms

Welcome to UrbanFix: CykelMester, operated by UrbanFix: CykelMester ("we," "us," "our," or "Company"). These Terms of Service ("Terms") govern your use of our mobile application, website, and related services (collectively, the "Service") that connect bicycle owners with bicycle repair professionals and workshops ("Service Providers"). By accessing or using our Service, creating an account, or making a booking, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our Service.

2. Definitions

"Customer" means an individual who uses our Service to request bicycle repair services. "Service Provider" means bicycle mechanics, repair shops, or other qualified professionals who offer bicycle repair services through our platform. "Platform" refers to our mobile application, website, and all related technology and services. "Booking" means a request for bicycle repair services made through our Platform. "Emergency Service" refers to priority bicycle repair services available for an additional fee.

3. Eligibility and Account Registration

You must be at least 18 years old to use our Service. By using our Service, you represent and warrant that you have the legal capacity to enter into these Terms. You must provide accurate, current, and complete information during registration and maintain the accuracy of this information. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4. Service Description

UrbanFix: CykelMester is a technology platform that facilitates connections between Customers seeking bicycle repair services and qualified Service Providers. We do not provide bicycle repair services directly but act as an intermediary platform. Service Providers are independent contractors and not employees or agents of UrbanFix: CykelMester. We do not guarantee the availability, quality, or timeliness of any bicycle repair services. All repair work is performed by independent Service Providers at their own discretion and responsibility.

5. Customer Responsibilities

As a Customer, you agree to: (a) provide accurate information about your bicycle and repair needs; (b) be present at the agreed location and time for service; (c) pay all applicable fees and charges; (d) treat Service Providers with respect and professionalism; (e) not use the Service for any illegal or unauthorized purpose; (f) comply with all applicable laws and regulations. You acknowledge that you are responsible for determining whether a Service Provider is appropriate for your needs.

6. Service Provider Responsibilities

Service Providers agree to: (a) provide accurate information about their qualifications, services, and pricing; (b) perform services in a professional and workmanlike manner; (c) maintain appropriate insurance and licenses as required by law; (d) respond to bookings in a timely manner; (e) arrive at the agreed location and time; (f) treat Customers with respect and professionalism; (g) comply with all applicable laws and regulations. Service Providers are solely responsible for the quality and safety of their work.

7. Booking and Cancellation Policy

Bookings can be made through our Platform and are subject to Service Provider availability. Booking confirmation does not guarantee service completion. Cancellation policies vary by Service Provider and are displayed during the booking process. Customers may cancel bookings according to the applicable cancellation policy. Late cancellations or no-shows may result in cancellation fees. UrbanFix: CykelMester reserves the right to cancel bookings for any reason, including suspected fraudulent activity or violations of these Terms.

8. Pricing and Payment

Service prices are set by individual Service Providers and displayed in the app. UrbanFix: CykelMester charges a platform fee for facilitating connections between Customers and Service Providers. All prices include applicable taxes unless otherwise specified. Payment is processed through our secure payment platform. We accept major credit cards, debit cards, and other payment methods as displayed in the app. Emergency services may incur additional fees of up to 50% of the base service price. Prices may vary based on location, demand, and other factors.

9. Refunds and Disputes

Refund policies are determined by individual Service Providers and may vary by service type and circumstances. UrbanFix: CykelMester does not guarantee refunds but will assist in mediating disputes between Customers and Service Providers. If you are unsatisfied with a service, you should first contact the Service Provider directly. If the issue cannot be resolved, you may contact our customer support team. All refund requests must be made within 14 days of service completion. Platform fees are generally non-refundable except in cases of our error or as required by law.

10. Quality Assurance and Safety

While we strive to work with qualified Service Providers, UrbanFix: CykelMester does not guarantee the quality, safety, or legality of services provided. Service Providers are independent contractors responsible for their own work quality and safety standards. We encourage Customers to verify Service Provider credentials and to report any safety concerns immediately. We reserve the right to remove Service Providers from our platform for quality or safety violations.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, URBANFIX: CYKELMESTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF €100 OR THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Insurance and Warranties

Service Providers are required to maintain appropriate professional liability insurance, though coverage amounts and terms may vary. UrbanFix: CykelMester does not provide insurance coverage for bicycle repairs or related services. WE PROVIDE THE SERVICE "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13. Intellectual Property

The Service, including its software, design, text, graphics, images, photographs, videos, audio, music, sounds, and other content, as well as our trademarks, service marks, and logos, are owned by or licensed to UrbanFix: CykelMester and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

14. User Content and Reviews

You may submit reviews, photos, and other content through our Service. You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Service. You represent that your content does not violate any third-party rights and complies with applicable laws. We reserve the right to remove any content that violates these Terms or is otherwise objectionable.

15. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service. By using our Service, you consent to the collection and use of information in accordance with our Privacy Policy. We comply with applicable data protection laws, including the EU General Data Protection Regulation (GDPR) where applicable.

16. Termination

You may terminate your account at any time by contacting customer support or using the account deletion feature in the app. We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately, though certain provisions of these Terms will survive termination.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by email, through the app, or by posting a notice on our website. Your continued use of the Service after such notification constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

18. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Denmark, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Copenhagen, Denmark, and you hereby consent to personal jurisdiction and venue in such courts.

19. Dispute Resolution

Before filing a lawsuit, you agree to try to resolve any dispute with us through good faith negotiation. If we cannot resolve a dispute through negotiation, any legal action must be filed within one year after the claim arose. Both parties may seek injunctive relief in court to protect intellectual property rights or confidential information.

20. Miscellaneous

These Terms constitute the entire agreement between you and UrbanFix: CykelMester regarding the Service. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver. You may not assign these Terms without our consent, but we may assign them without restriction.
